A kor\u00e1bbi \u00e9vekben a lengyel Cinkciarz t\u00e1rsas\u00e1g 13 megjel\u00f6l\u00e9sre vonatkoz\u00f3an adta be eur\u00f3pai uni\u00f3s v\u00e9djegyk\u00e9nt<\/strong> t\u00f6rt\u00e9n\u0151 bejelent\u00e9si k\u00e9relm\u00e9t a Spanyolorsz\u00e1gi Alicante v\u00e1ros\u00e1ban tal\u00e1lhat\u00f3 Eur\u00f3pai Uni\u00f3 Szellemi Tulajdoni Hivatal\u00e1n\u00e1l [a tov\u00e1bbiakban: EUIPO (European Union Intellectual Property Office)]. A v\u00e9djegybejelent\u00e9si elj\u00e1r\u00e1sban a Mastercard felsz\u00f3lal\u00e1st ny\u00fajtott be mind a 13 megjel\u00f6l\u00e9s ellen. A Mastercard felsz\u00f3lal\u00e1saiban arra hivatkozott, hogy a lajstromozni k\u00edv\u00e1nt megjel\u00f6l\u00e9sek az \u00f6sszet\u00e9veszthet\u0151s\u00e9gig hasonl\u00f3ak a Mastercard-nak az azonos \u00e1ruk \u00e9s szolg\u00e1ltat\u00e1sok tekintet\u00e9ben regisztr\u00e1lt kor\u00e1bbi v\u00e9djegyeihez. A felsz\u00f3lal\u00e1sokat az EUIPO 12 esetben alaptalannak min\u0151s\u00edtette \u00e9s elutas\u00edtotta, egy tov\u00e1bbi elj\u00e1r\u00e1st pedig felf\u00fcggesztett.<\/p>\n

V\u00e1laszul a Mastercard offenz\u00edv magatart\u00e1s\u00e1ra a Cinkciarz k\u00e9t t\u00f6rl\u00e9s ir\u00e1nti k\u00e9relmet ny\u00fajtott be az EUIPO-hoz, melyek jogalapjak\u00e9nt pedig a megk\u00fcl\u00f6nb\u00f6ztet\u0151 k\u00e9pess\u00e9g hi\u00e1ny\u00e1t jel\u00f6lte meg. A t\u00f6rl\u00e9s ir\u00e1nti elj\u00e1r\u00e1ssal \u00e9rintett Mastercard \u00e1br\u00e1s v\u00e9djegyek \u2013 az al\u00e1bb l\u00e1that\u00f3 m\u00f3don \u2013 k\u00e9t fekete-feh\u00e9r, egym\u00e1st \u00e1tfed\u0151 k\u00f6r\u00f6kb\u0151l \u00e1llnak:<\/p>\n

A v\u00e9delem kiterjeszt\u00e9se<\/strong><\/h4>\n

A Mastercard v\u00e1lasz\u00e1ban el\u0151adta, hogy az\u00e9rt lajstromoztatta m\u00e9g 2012. \u00e9vben Eur\u00f3pai Uni\u00f3s szinten a fenti v\u00e9djegyeket, mert \u2013 b\u00e1rmilyen sz\u00edn\u0171ek is legyenek a fenti m\u00f3don elhelyezett k\u00f6r\u00f6k \u2013 ki k\u00edv\u00e1nta terjeszteni azt az oltalmat, amelyet a j\u00f3l ismert, piros-s\u00e1rga sz\u00edn\u0171 egym\u00e1st \u00e1tfed\u0151 k\u00f6r\u00f6kb\u0151l \u00e1ll\u00f3 v\u00e9djegyei \u00e9lveznek. A Mastercard ezzel teh\u00e1t azt k\u00edv\u00e1nta el\u00e9rni, hogy b\u00e1rmilyen sz\u00edn\u0171, a fenti m\u00e9rt\u00e9kben egym\u00e1st \u00e1tfed\u0151 k\u00f6r\u00f6k v\u00e9djegyk\u00e9nt t\u00f6rt\u00e9n\u0151 bejegyz\u00e9se ellen sikerrel fell\u00e9phessen, hasonl\u00f3\u00a0 \u00e1ruk \u00e9s szolg\u00e1ltat\u00e1sok eset\u00e9n.<\/p>\n

A Cinkciarz azonban nem \u00e9rtett egyet az oltalom kiterjeszt\u00e9s\u00e9vel: mivel az \u0151 log\u00f3ja szint\u00e9n k\u00e9t egym\u00e1st \u00e1tfed\u0151 fekete-feh\u00e9r k\u00f6rb\u0151l \u00e1ll, att\u00f3l tartott, hogy saj\u00e1t log\u00f3ja a Mastercard v\u00e9djegyoltalma kiterjeszt\u00e9s\u00e9nek \u00e1ldozat\u00e1ul fog esni. A fenti el\u0151zm\u00e9nyek \u00e9s a Mastercard v\u00e9djegyoltalom-kiterjeszt\u0151 politik\u00e1ja vezettek a t\u00f6rl\u00e9s ir\u00e1nti k\u00e9relmek beny\u00fajt\u00e1s\u00e1ra.<\/p>\n

A Cinkciarz t\u00f6bbek k\u00f6z\u00f6tt azzal \u00e9rvelt, hogy nem lett volna szabad monop\u00f3liumot biztos\u00edtani a Mastercard r\u00e9sz\u00e9re a k\u00e9t egym\u00e1st \u00e1tfed\u0151 k\u00f6r haszn\u00e1lata felett, tov\u00e1bb\u00e1 a Mastercard r\u00e9sz\u00e9re sosem lett volna szabad enged\u00e9lyezni a fenti megjel\u00f6l\u00e9sek lajstromoz\u00e1s\u00e1t, mivel azok megjelen\u00e9s\u00fckben t\u00fal egyszer\u0171ek, \u00e1ltal\u00e1nosak \u00e9s megk\u00fcl\u00f6nb\u00f6ztet\u0151 k\u00e9pess\u00e9g\u00fck pedig nincsen. A Cinkciarz szerint a Mastercard v\u00e9djegyei az \u0151 al\u00e1bbi log\u00f3ihoz hasonl\u00edtanak:<\/p>\n

Tem\u00e9rdek bizony\u00edt\u00e9k, relevancia n\u00e9lk\u00fcl<\/strong><\/h4>\n

A Mastercard szerint a v\u00e9djegyei 1969. \u00f3ta t\u00f6bb mint 2,3 milli\u00e1rd darab, bank, hitel vagy egy\u00e9b t\u00edpus\u00fa k\u00e1rty\u00e1n jelentek meg vil\u00e1gszerte. Az ez\u00e1ltal megszerzett megk\u00fcl\u00f6nb\u00f6ztet\u0151 k\u00e9pess\u00e9g\u00e9vel el\u00e9rte, hogy a k\u00e9t egybees\u0151 k\u00f6rr\u0151l az emberek minden k\u00f6r\u00fclm\u00e9nyek k\u00f6z\u00f6tt a Mastercard v\u00e9djegy\u00e9t ismerj\u00e9k fel a hitel- \u00e9s bankk\u00e1rty\u00e1k, illetve a p\u00e9nz\u00fcgyi szolg\u00e1ltat\u00e1sok ter\u00fclet\u00e9n.<\/p>\n

Annak \u00e9rdek\u00e9ben, hogy az EUIPO-t a fekete-feh\u00e9r k\u00f6r\u00f6k szerzett megk\u00fcl\u00f6nb\u00f6ztet\u0151 k\u00e9pess\u00e9g\u00e9r\u0151l meggy\u0151zze, a Mastercard hatalmas mennyis\u00e9g\u0171 bizony\u00edt\u00e9kot szolg\u00e1ltatott a Hivatal r\u00e9sz\u00e9re, mely azonban v\u00e9g\u00fcl eredm\u00e9nytelennek bizonyult. B\u00e1r a Mastercard tem\u00e9rdek log\u00f3val ell\u00e1tott term\u00e9kr\u0151l szolg\u00e1ltatott bizony\u00edt\u00e9kot, egyik sem tartalmazott a fekete-feh\u00e9r v\u00e9djegyeinek haszn\u00e1lat\u00e1r\u00f3l \u00e9rdemi bizony\u00edt\u00e9kot. Enn\u00e9l fogva az EUIPO \u2013 miut\u00e1n feldolgozta az irrelev\u00e1nsnak min\u0151s\u00edtett adatmennyis\u00e9get \u2013 \u00fagy hat\u00e1rozott, hogy a Mastercard a fenti v\u00e9djegyeire nem terjesztheti ki m\u00e1r tov\u00e1bb az eml\u00edtett piros-s\u00e1rga v\u00e9djegyei \u00e1ltal \u00e9lvezett oltalmat: azaz a fekete-feh\u00e9r v\u00e9djegyek t\u00f6rl\u00e9sre ker\u00fcltek.<\/p>\n
