B\u00e1r a\u00a0nagyvil\u00e1gban m\u0171k\u00f6d\u0151, a\u00a0munkaviszony keret\u00e9ben l\u00e9trej\u00f6v\u0151 tal\u00e1lm\u00e1nyok jogi helyzet\u00e9t szab\u00e1lyoz\u00f3 kereteket sz\u00e1mos szempontb\u00f3l csoportos\u00edthatn\u00e1nk, p\u00e9ld\u00e1ul aszerint, hogy kit illetnek meg a\u00a0tal\u00e1lm\u00e1nyhoz f\u0171z\u0151d\u0151 jogok, hogy k\u00fcl\u00f6nbs\u00e9get tesznek-e att\u00f3l f\u00fcgg\u0151en, hogy a\u00a0tal\u00e1lm\u00e1ny l\u00e9trej\u00f6tte munkaviszonyb\u00f3l fakad\u00f3 k\u00f6telezetts\u00e9g eredm\u00e9nye, vagy sem stb., cikk\u00fcnkben a\u00a0szab\u00e1lyoz\u00e1si rendszereket aszerint csoportos\u00edtottuk, hogy a\u00a0feltal\u00e1l\u00f3t megilleti-e valamilyen d\u00edjaz\u00e1s kreat\u00edv tev\u00e9kenys\u00e9ge eredm\u00e9nyek\u00e9ppen, vagy nem.<\/p>\n<p style=\"text-align: justify\"><em>Kezdj\u00fck teh\u00e1t az\u00a0\u00e1ttekint\u00e9st \u2013\u00a0a\u00a0teljess\u00e9g ig\u00e9nye n\u00e9lk\u00fcl\u00a0\u2013 a\u00a0kreat\u00edv tev\u00e9kenys\u00e9g fej\u00e9ben tal\u00e1lm\u00e1nyi d\u00edjat alapvet\u0151en meg\u00e1llap\u00edt\u00f3 orsz\u00e1gokkal.<\/em><\/p>\n<p style=\"text-align: justify\"><strong>Magyarorsz\u00e1gon<\/strong>\u00a0\u2013 j\u00f3llehet a\u00a0tal\u00e1lm\u00e1ny eredetileg, azaz mun\u00adkaviszony hi\u00e1ny\u00e1ban a\u00a0feltal\u00e1l\u00f3t illeti meg \u2013 k\u00e9tf\u00e9le, munkaviszonnyal \u00f6sszef\u00fcgg\u00e9sben l\u00e9v\u0151 feltal\u00e1l\u00f3i jogviszonyt k\u00fcl\u00f6nb\u00f6ztet\u00fcnk meg:<\/p>\n<ol style=\"text-align: justify\">\n<li>Amennyiben a\u00a0tal\u00e1lm\u00e1ny t\u00e1rgyk\u00f6r\u00e9be es\u0151 megold\u00e1s l\u00e9trehoz\u00e1sa a\u00a0munkav\u00e1llal\u00f3nak munkaviszonyb\u00f3l sz\u00e1rmaz\u00f3 k\u00f6teless\u00e9ge, \u00fagy\u00a0<em>szolg\u00e1lati tal\u00e1lm\u00e1nyr\u00f3l<\/em> besz\u00e9l\u00fcnk, melyet a feltal\u00e1l\u00f3nak a\u00a0munk\u00e1ltat\u00f3 r\u00e9sz\u00e9re be kell jelentenie, \u00e9s melyre vonatkoz\u00f3 vagyoni jogok a\u00a0munkaad\u00f3t illetik \u2013\u00a0\u00edgy a\u00a0szabadalmi jogok is jogut\u00f3dl\u00e1s r\u00e9v\u00e9n a\u00a0munk\u00e1ltat\u00f3ra sz\u00e1llnak \u00e1t, azaz a\u00a0szabadalmi bejelent\u00e9s megt\u00e9tel\u00e9re is a\u00a0munk\u00e1ltat\u00f3nak ny\u00edlik lehet\u0151s\u00e9ge\u00a0\u2013, amennyiben ig\u00e9nyt tart a\u00a0szolg\u00e1lati tal\u00e1lm\u00e1nyra, ellent\u00e9telez\u00e9s\u00fcl pedig a\u00a0feltal\u00e1l\u00f3t a\u00a0hasznos\u00edt\u00e1sb\u00f3l sz\u00e1rmaz\u00f3 gazdas\u00e1gi el\u0151ny\u00f6kkel ar\u00e1nyos tal\u00e1lm\u00e1nyi d\u00edj illeti meg.<\/li>\n<li>Amennyiben a\u00a0tal\u00e1lm\u00e1ny t\u00e1rgyk\u00f6r\u00e9be es\u0151 megold\u00e1s l\u00e9trehoz\u00e1sa a\u00a0munkav\u00e1llal\u00f3nak nem munkaviszonyb\u00f3l sz\u00e1rmaz\u00f3 k\u00f6teless\u00e9ge, \u00fagy\u00a0<em>alkalmazotti tal\u00e1lm\u00e1ny<\/em>\u00a0j\u00f6n l\u00e9tre, melyre vonatkoz\u00f3an minden jog a\u00a0feltal\u00e1l\u00f3 munkav\u00e1llal\u00f3t illeti, \u00e1m a\u00a0munkaad\u00f3 fel\u00e9 t\u00f6rt\u00e9n\u0151 bejelent\u00e9si k\u00f6telezetts\u00e9g itt is fenn\u00e1ll, \u00e9s a\u00a0munk\u00e1ltat\u00f3t saj\u00e1t gazdas\u00e1gi tev\u00e9kenys\u00e9gi k\u00f6r\u00e9ben \u00e1t nem ruh\u00e1zhat\u00f3 nem kiz\u00e1r\u00f3lagos hasznos\u00edt\u00e1si jog illeti meg, tal\u00e1lm\u00e1nyi d\u00edj fej\u00e9ben.<\/li>\n<\/ol>\n<p style=\"text-align: justify\">A magyar szabadalmi t\u00f6rv\u00e9ny nem defini\u00e1lja a\u00a0m\u00e9lt\u00e1nyos d\u00edjaz\u00e1s m\u00e9rt\u00e9k\u00e9t, arra vonatkoz\u00f3an annyi t\u00e1mpontot ad, hogy annak ar\u00e1nyban kell \u00e1llnia azzal, amit az\u00a0ipar\u00e1gban megszokott licencforgalmi viszonyok alapj\u00e1n harmadik f\u00e9lnek a\u00a0hasznos\u00edt\u00e1sra adott enged\u00e9ly fej\u00e9ben a\u00a0munk\u00e1ltat\u00f3nak fizetnie kellene. Tov\u00e1bb\u00e1, a\u00a0fizetend\u0151 tal\u00e1lm\u00e1nyi d\u00edj m\u00e9rt\u00e9k\u00e9t befoly\u00e1solja a\u00a0munk\u00e1ltat\u00f3nak a\u00a0tal\u00e1lm\u00e1nyb\u00f3l ered\u0151 gazdas\u00e1gi el\u0151nye, a\u00a0tal\u00e1lm\u00e1ny megalkot\u00e1s\u00e1hoz ny\u00fajtott hozz\u00e1j\u00e1rul\u00e1sa \u00e9s\u00a0a\u00a0feltal\u00e1l\u00f3 munkaviszonyb\u00f3l ered\u0151 k\u00f6teless\u00e9g\u00e9nek fenn\u00e1llta vagy hi\u00e1nya. Ezen k\u00edv\u00fcl a\u00a0t\u00f6rv\u00e9ny olyan tal\u00e1lm\u00e1nyi d\u00edjszerz\u0151\u00add\u00e9s megk\u00f6t\u00e9s\u00e9t is lehet\u0151v\u00e9 teszi, amelyben meghat\u00e1rozott \u00f6sszeg\u0171 d\u00edjat \u00e1llap\u00edtanak meg a\u00a0feltal\u00e1l\u00f3 j\u00f6v\u0151ben megalkot\u00e1sra, illetve \u00e9rt\u00e9kes\u00edt\u00e9sre ker\u00fcl\u0151 tal\u00e1lm\u00e1nyaival kapcsolatban, me\u00adlyet <em>kock\u00e1zatmegoszt\u00e1sra ir\u00e1nyul\u00f3 tal\u00e1lm\u00e1nyi d\u00edjszerz\u0151\u00add\u00e9s\u00adnek<\/em> nevez\u00fcnk (p\u00e9ld\u00e1ul a\u00a0munkaszerz\u0151d\u00e9sben fix d\u00edj ne\u00adves\u00ed\u00ad\u00adt\u00e9se, avagy a\u00a0munkab\u00e9r egy r\u00e9sz\u00e9nek ilyet\u00e9n neves\u00edt\u00e9se).<\/p>\n<p style=\"text-align: justify\"><strong>N\u00e9metorsz\u00e1gban<\/strong>\u00a0\u2013\u00a0a\u00a0magyar szab\u00e1lyoz\u00e1shoz hasonl\u00f3an\u00a0\u2013 a\u00a0tal\u00e1lm\u00e1ny eredetileg a\u00a0feltal\u00e1l\u00f3t illeti meg, de szolg\u00e1lati \u00e9s alkalmazotti tal\u00e1lm\u00e1ny eset\u00e9ben k\u00f6teles ezt ismertetni a\u00a0munk\u00e1l\u00adtat\u00f3\u00adval, aki sz\u00e1m\u00e1ra a\u00a0t\u00f6rv\u00e9ny erej\u00e9n\u00e9l fogva jogut\u00f3dl\u00e1s k\u00f6vetkezik be a\u00a0szolg\u00e1lati tal\u00e1lm\u00e1nyokra, ha kinyilv\u00e1n\u00edtja az\u00a0erre vonatkoz\u00f3 ig\u00e9ny\u00e9t. Ebben az\u00a0esetben azonban tal\u00e1lm\u00e1nyi d\u00edjat kell fizetni a\u00a0feltal\u00e1l\u00f3 munkav\u00e1llal\u00f3nak. A\u00a0feltal\u00e1l\u00f3nak j\u00e1r\u00f3 r\u00e9szar\u00e1ny a\u00a0t\u00f6rv\u00e9nyben meghat\u00e1rozottak szerint az\u00a0al\u00e1bbiakt\u00f3l f\u00fcgg:<\/p>\n<ul style=\"text-align: justify\">\n<li>a szolg\u00e1lati tal\u00e1lm\u00e1ny gazdas\u00e1gi hasznos\u00edthat\u00f3s\u00e1ga, vagyis a tal\u00e1lm\u00e1ny \u00e9rt\u00e9ke, melyet h\u00e1rom m\u00f3dszerrel lehet meghat\u00e1rozni a jogszab\u00e1ly \u00e9rtelm\u00e9ben:<\/li>\n<\/ul>\n<ol style=\"text-align: justify\">\n<li style=\"list-style-type: none\">\n<ol>\n<li>A\u00a0licenciaanal\u00f3gi\u00e1t haszn\u00e1lva, azaz licenciad\u00edj meghat\u00e1roz\u00e1s\u00e1val, amelyet egy hasonl\u00f3, harmadik f\u00e9l \u00e1ltal birtokolt tal\u00e1lm\u00e1ny\u00e9rt kellene fizetni;<\/li>\n<li>A\u00a0tal\u00e1lm\u00e1nyb\u00f3l a\u00a0munk\u00e1ltat\u00f3hoz befoly\u00f3 haszon, azaz a\u00a0tal\u00e1lm\u00e1ny hasznos\u00edt\u00e1s\u00e1b\u00f3l ered\u0151 r\u00e1ford\u00edt\u00e1s \u00e9s bev\u00e9tel k\u00f6z\u00f6tti k\u00fcl\u00f6nbs\u00e9g kisz\u00e1m\u00edt\u00e1s\u00e1val, vagy<\/li>\n<li>A tal\u00e1lm\u00e1ny \u00e9rt\u00e9k\u00e9nek megbecs\u00fcl\u00e9s\u00e9vel, azaz annak az \u00e1rnak a meghat\u00e1roz\u00e1s\u00e1val, amelyet a munk\u00e1ltat\u00f3nak akkor kellene fizetnie, ha egy\u00e9ni feltal\u00e1l\u00f3t\u00f3l venn\u00e9 meg a tal\u00e1lm\u00e1nyt.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<ul style=\"text-align: justify\">\n<li>a\u00a0munkav\u00e1llal\u00f3nak a\u00a0munk\u00e1ltat\u00f3n\u00e1l bet\u00f6lt\u00f6tt munka\u00adk\u00f6re \u00e9s poz\u00edci\u00f3ja;<\/li>\n<li>a\u00a0c\u00e9g bevon\u00e1s\u00e1nak m\u00e9rt\u00e9ke a\u00a0szolg\u00e1lati tal\u00e1lm\u00e1ny l\u00e9tre\u00adhozatal\u00e1ba.<\/li>\n<\/ul>\n<p style=\"text-align: justify\"><strong>Sv\u00e1jcban<\/strong>\u00a0\u00e9s\u00a0<strong>Liechtensteinben<\/strong>\u00a0a\u00a0munkav\u00e1llal\u00f3nak a\u00a0szo\u00adk\u00e1sos munkafeladatai ell\u00e1t\u00e1sa k\u00f6zben sz\u00fcletett tal\u00e1lm\u00e1nyait be kell jelentenie a\u00a0munk\u00e1ltat\u00f3nak. A\u00a0tal\u00e1lm\u00e1nyhoz f\u0171z\u0151d\u0151 jogok a\u00a0munk\u00e1ltat\u00f3hoz ker\u00fclnek, aki k\u00f6teles ez\u00e9rt tal\u00e1lm\u00e1nyi d\u00edjat fizetni. Ennek m\u00e9rt\u00e9ke f\u00fcgg a\u00a0szolg\u00e1lati tal\u00e1lm\u00e1ny gazdas\u00e1gi \u00e9rt\u00e9k\u00e9t\u0151l, a\u00a0munkav\u00e1llal\u00f3 c\u00e9gn\u00e9l bet\u00f6lt\u00f6tt poz\u00edci\u00f3j\u00e1t\u00f3l \u00e9s feladatait\u00f3l, a\u00a0munk\u00e1ltat\u00f3 vagy harmadik f\u00e9l hozz\u00e1j\u00e1rul\u00e1s\u00e1t\u00f3l \u00e9s att\u00f3l, hogy a\u00a0tal\u00e1lm\u00e1ny kidolgoz\u00e1s\u00e1hoz milyen m\u00e9rt\u00e9kben vett\u00e9k ig\u00e9nybe a\u00a0munk\u00e1ltat\u00f3 infrastrukt\u00far\u00e1j\u00e1t.<\/p>\n<p style=\"text-align: justify\"><strong>Olaszorsz\u00e1gban<\/strong>\u00a0ellent\u00e9tes tartalm\u00fa meg\u00e1llapod\u00e1s hi\u00e1ny\u00e1ban a\u00a0feltal\u00e1l\u00f3 m\u00e9lt\u00e1nyos d\u00edjra jogosult a\u00a0tal\u00e1lm\u00e1ny gazdas\u00e1gi \u00e9rt\u00e9k\u00e9t\u0151l f\u00fcgg\u0151en. A\u00a0feltal\u00e1l\u00f3nak fizetend\u0151 d\u00edj azzal ar\u00e1nyosan cs\u00f6kken, amilyen m\u00e9rt\u00e9kben a\u00a0munk\u00e1ltat\u00f3 is r\u00e9szt vesz a\u00a0tal\u00e1lm\u00e1ny kidolgoz\u00e1s\u00e1ban.<\/p>\n<h5 style=\"text-align: justify\"><strong>\u00c1ltal\u00e1ban munkak\u00f6ri k\u00f6telezetts\u00e9gnek tekintik a\u00a0tal\u00e1lm\u00e1nyok megalkot\u00e1s\u00e1t ellenkez\u0151 rendelkez\u00e9s hi\u00e1ny\u00e1ban a\u00a0k\u00f6vetkez\u0151 orsz\u00e1gok szab\u00e1lyoz\u00e1sa, illetve gyakorlata szerint.<\/strong><\/h5>\n<p style=\"text-align: justify\">Az\u00a0<strong>Amerikai Egyes\u00fclt \u00c1llamokban<\/strong>\u00a0nincs k\u00fcl\u00f6n a\u00a0tal\u00e1lm\u00e1nyi d\u00edjra vonatkoz\u00f3 jogi szab\u00e1lyoz\u00e1s. Az\u00a0alapelv az, hogy a\u00a0tal\u00e1lm\u00e1ny a\u00a0feltal\u00e1l\u00f3t illeti, \u00edgy a\u00a0szabadalmi bejelent\u00e9st mindig a\u00a0feltal\u00e1l\u00f3 nev\u00e9ben ny\u00fajtj\u00e1k be, mely k\u00e9s\u0151bb ruh\u00e1zhat\u00f3 \u00e1t a\u00a0munk\u00e1ltat\u00f3ra. A\u00a0tal\u00e1lm\u00e1ny \u00e1truh\u00e1z\u00e1s\u00e1nak felt\u00e9teleit szerz\u0151d\u00e9sben kell szab\u00e1lyozni.<br \/>\nAz Amerikai Egyes\u00fclt \u00c1llamokban szok\u00e1sos munkaszerz\u0151d\u00e9sek a\u00a0k\u00f6vetkez\u0151 k\u00f6telezetts\u00e9geket tartalmazz\u00e1k a\u00a0munkav\u00e1llal\u00f3k \u00e1ltal l\u00e9trehozott tal\u00e1lm\u00e1nyokra n\u00e9zve:<\/p>\n<ul style=\"text-align: justify\">\n<li>a\u00a0feltal\u00e1l\u00f3nak minden tal\u00e1lm\u00e1ny\u00e1r\u00f3l \u00e9rtes\u00edtenie kell a\u00a0munk\u00e1ltat\u00f3t;<\/li>\n<li>a\u00a0feltal\u00e1l\u00f3nak m\u00e1sokkal szemben titokban kell tartania minden tal\u00e1lm\u00e1nyt vagy a\u00a0c\u00e9ggel kapcsolatos inform\u00e1ci\u00f3t;<\/li>\n<li>a\u00a0feltal\u00e1l\u00f3nak minden, a\u00a0tal\u00e1lm\u00e1nyhoz f\u0171z\u0151d\u0151 jogot \u00e1t kell ruh\u00e1znia a\u00a0munk\u00e1ltat\u00f3ra, ugyanakkor ennek fej\u00e9ben a\u00a0feltal\u00e1l\u00f3nak nincs joga d\u00edjaz\u00e1st ig\u00e9nyelni. Ellenkez\u0151 esetben a\u00a0d\u00edjaz\u00e1st a\u00a0munkaszerz\u0151d\u00e9sben is lehet szab\u00e1lyozni.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">Azokban az\u00a0esetekben, amikor nincs ilyen szerz\u0151d\u00e9ses megegyez\u00e9s a\u00a0munk\u00e1ltat\u00f3 \u00e9s a\u00a0feltal\u00e1l\u00f3 k\u00f6z\u00f6tt, ugyanakkor a\u00a0munk\u00e1ltat\u00f3nak nagy szerepe volt a\u00a0tal\u00e1lm\u00e1ny l\u00e9tre\u00adhozatal\u00e1\u00adban (p\u00e9ld\u00e1ul mert ell\u00e1tta a\u00a0feltal\u00e1l\u00f3t a\u00a0sz\u00fcks\u00e9ges eszk\u00f6z\u00f6kkel, anyagokkal vagy p\u00e9nz\u00fcgyi forr\u00e1sokkal), a\u00a0munk\u00e1ltat\u00f3 egy \u00fagynevezett \u201eshop right\u201d jogot kap, mely alapj\u00e1n nem-kiz\u00e1r\u00f3lagos licenci\u00e1ra (hasznos\u00edt\u00e1si jogra) jogosult. Cser\u00e9be a\u00a0munk\u00e1ltat\u00f3 1 doll\u00e1r licenciad\u00edjat fizet szimbolikus feltal\u00e1l\u00f3i d\u00edjk\u00e9nt.<\/p>\n<p style=\"text-align: justify\">Az\u00a0<strong>Egyes\u00fclt Kir\u00e1lys\u00e1gban<\/strong>\u00a0azok a\u00a0tal\u00e1lm\u00e1nyok, amelyek a\u00a0munkav\u00e1llal\u00f3 szok\u00e1sos munka\u00adk\u00f6r\u00e9nek ell\u00e1t\u00e1sa sor\u00e1n vagy a\u00a0szok\u00e1sos munkak\u00f6r\u00e9n k\u00edv\u00fcl es\u0151, de kifejezetten r\u00e1b\u00edzott feladatok ell\u00e1t\u00e1sa sor\u00e1n keletkeztek, a\u00a0munk\u00e1ltat\u00f3t illetik. A\u00a0t\u00f6bbi tal\u00e1lm\u00e1ny a\u00a0feltal\u00e1l\u00f3t illeti.
