Ez\u00fattal arra v\u00e1llalkozunk, hogy a nemzetk\u00f6zi adatok alapj\u00e1n megvizsg\u00e1ljuk a v\u00e1llalati \u00f6szt\u00f6nz\u0151rendszereket, az alkalmazott egyes elemeket, gyakoris\u00e1gukat \u00e9s v\u00e9lhet\u0151en optim\u00e1lis \u00f6sszet\u00e9tel\u00fcket.<\/p>\n<p style=\"text-align: justify\">Ami a\u00a0nemzetk\u00f6zi gyakorlatot illeti, a\u00a0v\u00e1llalaton bel\u00fcli, kreativit\u00e1sra ir\u00e1nyul\u00f3 motiv\u00e1ci\u00f3ban az\u00a0anyagi \u00f6szt\u00f6nz\u0151k, f\u0151leg a\u00a0tal\u00e1lm\u00e1nyi d\u00edj fontoss\u00e1g\u00e1t t\u00f6bb kutat\u00e1s is meger\u0151s\u00edtette. Egy 522\u00a0feltal\u00e1l\u00f3 bevon\u00e1s\u00e1val k\u00e9sz\u00edtett felm\u00e9r\u00e9s eredm\u00e9nye szerint a\u00a0feltal\u00e1l\u00f3k t\u00f6bb mint 70\u00a0sz\u00e1zal\u00e9ka fontosnak tartotta a\u00a0tal\u00e1lm\u00e1nyi d\u00edjat. Egy m\u00e1sik tanulm\u00e1ny ugyanakkor kimutatta, hogy a\u00a0tal\u00e1lm\u00e1ny l\u00e9trej\u00f6tte \u00e9s annak piacra ker\u00fcl\u00e9se, teh\u00e1t a\u00a0d\u00edj kifizet\u00e9se k\u00f6z\u00f6tt legal\u00e1bb hat \u00e9v telik el. \u00cdgy azt\u00e1n a\u00a0kreat\u00edv alkot\u00f3munka elv\u00e9gz\u00e9se \u00e9s eredm\u00e9nye gy\u00fcm\u00f6lcs\u00e9nek learat\u00e1sa a\u00a0feltal\u00e1l\u00f3 szempontj\u00e1b\u00f3l jelent\u0151s m\u00e9rt\u00e9kben elv\u00e1lik egym\u00e1st\u00f3l, ami a\u00a0motiv\u00e1ci\u00f3s hat\u00e1st jelent\u0151sen lerontja. R\u00e1ad\u00e1sul az\u00a0\u00e9ves gyakoris\u00e1g\u00fa \u00e9rt\u00e9kes\u00edt\u00e9si nett\u00f3 bev\u00e9tel alap\u00fa tal\u00e1lm\u00e1nyi d\u00edjkifizet\u00e9sek t\u00falzott adminisztr\u00e1ci\u00f3s teherrel \u00e9s\u00a0k\u00f6lts\u00e9ggel j\u00e1rnak, emiatt a\u00a0v\u00e1llalkoz\u00e1sok nemigen motiv\u00e1ltak ebben a\u00a0d\u00edjsz\u00e1m\u00edt\u00e1si modellben.<\/p>\n<p style=\"text-align: justify\">M\u00e9g egy gyakran vitatott t\u00e9ma a\u00a0d\u00edjaz\u00e1s konkr\u00e9t kisz\u00e1m\u00edt\u00e1s\u00e1t b\u00edr\u00e1lja, nevezetesen, hogy a\u00a0term\u00e9kkel el\u00e9rt \u00f6sszes forgalom ar\u00e1ny\u00e1ban, \u00e9s nem a\u00a0tal\u00e1lm\u00e1nynak k\u00f6sz\u00f6nhet\u0151 t\u00e9nyleges \u00e9rt\u00e9kes\u00edt\u00e9s\u00adn\u00f6veked\u00e9s\u00adhez k\u00f6t\u00f6tten sz\u00e1molj\u00e1k ki a\u00a0d\u00edjat. Ez alapj\u00e1n ugyanis az\u00a0\u00fatt\u00f6r\u0151 jelleg\u0171 tal\u00e1lm\u00e1nyok (melyek kezdetben kev\u00e9s bev\u00e9telt gener\u00e1lnak, de nagy a\u00a0viszonylagos bev\u00e9teln\u00f6veke\u00add\u00e9s) h\u00e1tr\u00e1nyba ker\u00fclnek a\u00a0piacon m\u00e1r j\u00f3l be\u00advezetett term\u00e9kek tov\u00e1bb\u00adfejleszt\u00e9\u00ads\u00e9ben testet \u00f6lt\u0151 tal\u00e1lm\u00e1nyokkal szemben, ami mindenk\u00e9ppen igazs\u00e1g\u00adtalan\u00adnak t\u0171nik a\u00a0fel\u00adtal\u00e1l\u00f3i hozz\u00e1\u00adadott \u00e9rt\u00e9k szintj\u00e9t alapul v\u00e9ve.<\/p>\n<p style=\"text-align: justify\">Az <strong>Eur\u00f3pai Bizotts\u00e1g<\/strong> e t\u00e9m\u00e1ban v\u00e9gzett, <strong>PatVal projekt<\/strong> nev\u0171 kutat\u00e1s\u00e1ban 1983 feltal\u00e1l\u00f3t\u00f3l vissza\u00e9rkezett k\u00e9rd\u0151\u00edv ada\u00adtait tartalmazta a\u00a0feltal\u00e1l\u00f3i d\u00edjaz\u00e1ssal kapcsolatos k\u00e9rd\u00e9s\u00adk\u00f6r\u00f6kben. A\u00a0felm\u00e9r\u00e9sb\u0151l kider\u00fclt, hogy a\u00a0legt\u00f6bb feltal\u00e1l\u00f3 (77,9\u00a0sz\u00e1zal\u00e9k) egy\u00e1ltal\u00e1n nem, vagy csak kev\u00e9s d\u00edjban r\u00e9szes\u00fclt, \u00e9s csak eleny\u00e9sz\u0151 sz\u00e1m\u00fa feltal\u00e1l\u00f3 kapott jelent\u0151s \u00f6ssze\u00adget a\u00a0brutt\u00f3 fizet\u00e9se mell\u00e9. T\u00edz tal\u00e1lm\u00e1nyb\u00f3l nyolc gyakorlatilag nem termel ki tal\u00e1lm\u00e1nyi d\u00edjat meg\u00adalkot\u00f3j\u00e1nak, \u00e9s csup\u00e1n a\u00a0tal\u00e1lm\u00e1nyok 1\u00a0sz\u00e1zal\u00e9ka gener\u00e1lt megalkot\u00f3j\u00e1nak tetemes, az\u00a0\u00e9ves fizet\u00e9s\u00e9nek t\u00f6bb mint 20\u00a0sz\u00e1zal\u00e9k\u00e1val megegyez\u0151 m\u00e9rt\u00e9k\u0171 bev\u00e9telt, \u00e1m senki sem r\u00e9szes\u00fclt a\u00a0teljes \u00e9ves brutt\u00f3 b\u00e9r\u00e9n\u00e9l nagyobb tal\u00e1lm\u00e1nyi d\u00edjban egy bizonyos szabadalo\u00adm\u00e9rt. A\u00a0vizsg\u00e1lt szabadalmakra vonatkoz\u00f3 tal\u00e1lm\u00e1nyi d\u00edj \u00e1tlaga az\u00a0\u00e9ves brutt\u00f3 j\u00f6vedelem 1,8\u00a0sz\u00e1zal\u00e9k\u00e1val megegyez\u0151 m\u00e9rt\u00e9k\u0171 volt.<\/p>\n<p style=\"text-align: justify\">M\u00e9g amennyiben a\u00a0t\u00f6bbsz\u00f6r\u00f6s feltal\u00e1l\u00f3kat \u00f6ssze\u00advontan is sz\u00e1m\u00edtjuk a\u00a0mint\u00e1ban, akkor is elmondhat\u00f3, hogy a\u00a0feltal\u00e1l\u00f3k h\u00e1romn\u00adegyede 5\u00a0sz\u00e1zal\u00e9k vagy ann\u00e1l kevesebb tal\u00e1lm\u00e1nyi d\u00edjban r\u00e9szes\u00fclt a\u00a0brutt\u00f3 fizet\u00e9s\u00e9hez viszony\u00edtva. Ezzel szemben az\u00a0\u00f6sszes szabadalmuk ut\u00e1n j\u00e1r\u00f3 d\u00edjnak k\u00f6sz\u00f6n\u00adhet\u0151en \u00f6sszess\u00e9\u00adg\u00e9ben 18\u00a0feltal\u00e1l\u00f3 \u2013\u00a0azaz minden sz\u00e1zadik\u00a0\u2013 r\u00e9szes\u00fclt nagyobb \u00f6sszegben, mint az\u00a0\u00e9ves bev\u00e9tele, akik k\u00f6z\u00fcl egy\u00advalaki az\u00a0\u00e9ves brutt\u00f3 b\u00e9r\u00e9nek \u00f6tsz\u00f6r\u00f6s\u00e9t kapta. Ha a\u00a0tal\u00e1lm\u00e1nyaik ut\u00e1n kapott d\u00edjakat \u00f6sszevonjuk, \u00e1tlagosan \u00e9ves brutt\u00f3 munkab\u00e9r\u00fck 8,3\u00a0sz\u00e1zal\u00e9k\u00e1val megegyez\u0151 d\u00edjban r\u00e9szes\u00fcltek a\u00a0feltal\u00e1l\u00f3k.<\/p>\n<h4 style=\"text-align: justify\">A munka\u00adv\u00e1llal\u00f3i st\u00e1tuszban sz\u00fcletett tal\u00e1lm\u00e1nyok d\u00edjaz\u00e1\u00ads\u00e1nak nemzetk\u00f6zi gyakorlat\u00e1nak vizsg\u00e1lata alapj\u00e1n els\u0151dlegesen a k\u00f6vetkez\u0151 tanuls\u00e1gokat vonhatjuk le:<\/h4>\n<ul style=\"text-align: justify\">\n<li>Bizony\u00edthat\u00f3an a munkak\u00f6ri k\u00f6telezetts\u00e9g r\u00e9szek\u00e9nt l\u00e9trehozott tal\u00e1lm\u00e1nyok kompenz\u00e1l\u00e1s\u00e1nak a forr\u00e1sa els\u0151sorban a munkab\u00e9r. Ez egy\u00e9rtelm\u0171en abba az ir\u00e1nyba mutat, hogy a modern feltal\u00e1l\u00f3i st\u00e1tuszban m\u0171k\u00f6d\u0151 munkav\u00e1llal\u00f3k val\u00f3j\u00e1ban professzion\u00e1lis kutat\u00f3k (illetve kutat\u00f3csoportok), akiknek (amelyeknek) deklar\u00e1lt feladatuk hasznos, \u00faj tud\u00e1s l\u00e9trehoz\u00e1sa, \u00e9s annak az anyaint\u00e9zm\u00e9ny jav\u00e1ra ford\u00edt\u00e1sa.<\/li>\n<\/ul>\n<ul style=\"text-align: justify\">\n<li>Nagy biztons\u00e1ggal felt\u00e9telezhet\u0151, hogy a kifizetett tal\u00e1lm\u00e1nyi d\u00edjak ilyen m\u00e9rt\u00e9ke nem alapoz\u00f3dhat \u2013 az egy\u00e9bk\u00e9nt a magyar szab\u00e1lyoz\u00e1s \u00e1ltal f\u0151szab\u00e1lyk\u00e9nt kezelt \u2013 licenciaanal\u00f3gi\u00e1ra. Sokkal val\u00f3sz\u00edn\u0171bb, hogy a fentiekben elemzett kifizet\u00e9sek t\u00f6bbs\u00e9ge a kock\u00e1zatmegoszt\u00e1son alapul\u00f3 d\u00edjfizet\u00e9si modell szerint t\u00f6rt\u00e9nik, amikor a munkav\u00e1llal\u00f3 fizet\u00e9s\u00e9nek egy h\u00e1nyad\u00e1t kifejezetten az\u00e9rt \u00e9s annak ellent\u00e9telez\u00e9s\u00e9re kapja, hogy tal\u00e1lm\u00e1nyokat alkosson.<\/li>\n<\/ul>\n<ul style=\"text-align: justify\">\n<li>A tal\u00e1lm\u00e1nyi d\u00edjfizet\u00e9s m\u00e9rt\u00e9k\u00e9t illet\u0151en felt\u00e9telezhet\u0151, hogy a magasabb beoszt\u00e1sban dolgoz\u00f3 munkav\u00e1llal\u00f3k ar\u00e1nyaiban kevesebb tal\u00e1lm\u00e1nyi d\u00edjat realiz\u00e1lnak a brutt\u00f3 munkab\u00e9r\u00fckh\u00f6z viszony\u00edtva. Ez alapvet\u0151en k\u00e9t okra vezethet\u0151 vissza:<\/li>\n<\/ul>\n<ul style=\"text-align: justify\">\n<li style=\"list-style-type: none\">\n<ul>\n<li>egyr\u00e9szt a\u00a0magasabb beoszt\u00e1sban dolgoz\u00f3 feltal\u00e1l\u00f3 \u00f6sszehasonl\u00edt\u00e1si alapja \u2013 azaz brutt\u00f3 b\u00e9re \u2013 is magasabb, ami rontja a\u00a0tal\u00e1lm\u00e1nyi d\u00edjh\u00e1nyadra es\u0151 sz\u00e1zal\u00e9kos ar\u00e1nyt;<\/li>\n<li>m\u00e1sr\u00e9szt a magasabb beoszt\u00e1st\u00f3l nagyobb c\u00e9g ir\u00e1nti elk\u00f6telezetts\u00e9get v\u00e1rnak el, ami \u2013 p\u00e1rosulva a magasabb munkab\u00e9rrel \u2013 a tal\u00e1lm\u00e1nyi d\u00edjig\u00e9ny cs\u00f6kkent\u00e9se ir\u00e1ny\u00e1ba hat.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul style=\"text-align: justify\">\n<li>A\u00a0csapatmunk\u00e1ban alkotott tal\u00e1lm\u00e1nyok eset\u00e9ben az\u00a0egy feltal\u00e1l\u00f3ra es\u0151 tal\u00e1lm\u00e1nyi d\u00edj ar\u00e1nyaiban is kevesebb ahhoz k\u00e9pest, mint ha a\u00a0tal\u00e1lm\u00e1nyt egyvalaki alkotta volna meg. A\u00a0modern kutat\u00e1s-fejleszt\u00e9s \u00e9s innov\u00e1ci\u00f3 mindazon\u00e1ltal visszaford\u00edthatatlanul a\u00a0kutat\u00f3csoporton bel\u00fcli egy\u00fcttm\u0171k\u00f6d\u00e9st \u00e9s k\u00f6z\u00f6s feltal\u00e1l\u00e1st k\u00f6veteli meg, \u00edgy indokolt a\u00a0tal\u00e1lm\u00e1nyi d\u00edjaz\u00e1si gyakorlatnak figyelembe venni azt a\u00a0k\u00f6r\u00fclm\u00e9nyt, hogy a\u00a0tal\u00e1lm\u00e1nyt egy vagy t\u00f6bb feltal\u00e1l\u00f3 alkotta.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">A fentieknek megfelel\u0151en a\u00a0v\u00e1llalatoknak a\u00a0tal\u00e1lm\u00e1nyi d\u00edjaz\u00e1s gazdas\u00e1gi modellj\u00e9nek kialak\u00edt\u00e1s\u00e1ra vonatkoz\u00f3an azt a\u00a0tan\u00e1csot adhatjuk, hogy c\u00e9lszer\u0171, ha az\u00a0egyedi t\u00e1rgyal\u00e1son alapul\u00f3 licenciaanal\u00f3gia helyett a\u00a0kock\u00e1zatmegoszt\u00e1son alapul\u00f3 modell ker\u00fcl el\u0151t\u00e9rbe a\u00a0k\u00f6vetkez\u0151 alapelvek szerint:<\/p>\n<ul style=\"text-align: justify\">\n<li>a munkav\u00e1llal\u00f3 b\u00e9r\u00e9nek egy h\u00e1nyad\u00e1t (legfeljebb 10 sz\u00e1zal\u00e9kot) kifejezetten a feltal\u00e1l\u00f3i munka, mint munkak\u00f6ri k\u00f6te\u00adlezetts\u00e9g, ellent\u00e9telez\u00e9s\u00e9re indokolt neves\u00edteni;<\/li>\n<\/ul>\n<ul style=\"text-align: justify\">\n<li>a munkav\u00e1llal\u00f3t a szellemi alkot\u00e1s l\u00e9trehoz\u00e1sa ut\u00e1n indo\u00adkolt p\u00e9nz\u00fcgyileg is motiv\u00e1lni, ez\u00e9rt meghat\u00e1rozott, fix \u00f6sszeg\u0171 tal\u00e1lm\u00e1nyi d\u00edjban indokolt r\u00e9szes\u00edteni, amely d\u00edj egyszer, meghat\u00e1rozott m\u00e9rf\u00f6ldk\u0151 el\u00e9r\u00e9se eset\u00e9n, kiv\u00e9teles jelleggel megism\u00e9telhet\u0151;<\/li>\n<\/ul>\n<ul style=\"text-align: justify\">\n<li>a d\u00edjat az alkot\u00f3nak a lehet\u0151 leghamarabb, de legk\u00e9s\u0151bb az \u00fczleti hasznos\u00edt\u00e1s megkezd\u00e9sekor rendelkez\u00e9s\u00e9re kell bocs\u00e1tani; \u00e9s semmik\u00e9ppen nem megv\u00e1rni az adott oltalmi forma joger\u0151s enged\u00e9lyez\u00e9s\u00e9t;<\/li>\n<\/ul>\n<ul style=\"text-align: justify\">\n<li>a munk\u00e1ltat\u00f3 szempontj\u00e1b\u00f3l legfontosabb n\u00e9h\u00e1ny, \u00fagyneve\u00adzett strat\u00e9giai szellemi alkot\u00e1s tekintet\u00e9ben sem indokolt a licenciaanal\u00f3gia, mert az megnyitja a jogvit\u00e1k kock\u00e1zat\u00e1t;<\/li>\n<\/ul>\n<ul style=\"text-align: justify\">\n<li>a d\u00edjaz\u00e1si modell legyen teljesen f\u00fcggetlen a hasznos\u00edt\u00e1s m\u00f3dj\u00e1t\u00f3l: gy\u00e1rt\u00e1s, haszn\u00e1latbav\u00e9tel, licencia, \u00e9rt\u00e9kes\u00edt\u00e9s stb.;<\/li>\n<\/ul>\n<ul style=\"text-align: justify\">\n<li>az\u00a0elismer\u00e9s kifejez\u00e9s\u00e9re p\u00e9nzbeli mellett nem p\u00e9nzbeli \u00f6szt\u00f6nz\u0151ket is haszn\u00e1lnak, elengedhetetlen \u00f6szt\u00f6nz\u0151k a\u00a0d\u00edjak, d\u00edszvacsor\u00e1k, eml\u00e9klapok stb., mivel viszonylag alacsony k\u00f6lts\u00e9ggel j\u00e1rnak, de az\u00a0alkalmazottak igen nagyra becs\u00fclik az\u00a0elismer\u00e9s e form\u00e1it.<\/li>\n<\/ul>\n<p style=\"text-align: justify\">Egy 2010-ben az\u00a0egy\u00e9ni motiv\u00e1ci\u00f3 \u00e9s az\u00a0innovativit\u00e1s k\u00f6z\u00f6tti kapcsolatot vizsg\u00e1l\u00f3 kutat\u00e1s azt mutatta ki, hogy a\u00a0PhD-hallgat\u00f3k \u00e9s gyakorl\u00f3 szakemberek sz\u00e1m\u00e1ra egyar\u00e1nt az\u00a0intellektu\u00e1lis kih\u00edv\u00e1s \u00e9s a\u00a0f\u00fcggetlens\u00e9g a\u00a0legfontosabb, a\u00a0szellemi tev\u00e9kenys\u00e9ggel j\u00e1r\u00f3 \u00f6r\u00f6m \u00e9s el\u00e9gedetts\u00e9g \u00e9rz\u00e9se teh\u00e1t m\u00e9g ma is nagyobb vonzer\u0151t jelent, mint a\u00a0puszta anyagiak.<\/p>\n<p style=\"text-align: justify\">Egy az\u00a0<strong>Egyes\u00fclt Kir\u00e1lys\u00e1gban<\/strong> v\u00e9gzett felm\u00e9r\u00e9sben 38 c\u00e9g vett r\u00e9szt, melyek lefedt\u00e9k a\u00a0kifejezetten innovat\u00edv c\u00e9gek teljes gazdas\u00e1gi spektrum\u00e1t, az\u00a0\u00e9ves 400\u00a0milli\u00f3t\u00f3l a\u00a0177\u00a0milli\u00e1rd doll\u00e1rig terjed\u0151 sk\u00e1l\u00e1n.\u00a0A\u00a0felm\u00e9r\u00e9s sor\u00e1n kapott v\u00e1laszok alapj\u00e1n a\u00a0nem p\u00e9nzben adott feltal\u00e1l\u00f3i jutalmaz\u00e1sok megoszl\u00e1sa a\u00a0k\u00f6vetkez\u0151 volt:\u00a0<strong>eml\u00e9klap: 66 sz\u00e1zal\u00e9k;
